CIVIL LAW - REQUEST FOR DISMISSAL - A "Request for Dismissal" is a legal term that means asking a court to officially end a case, essentially removing it from the court's active docket, by dismissing it; this is usually done by filing a formal document with the court requesting the dismissal of a lawsuit or legal action. (All State Courts).
Either the plaintiff (the person filing the lawsuit) or the defendant (the person being sued) can request dismissal depending on the circumstances. Parties might request dismissal if they reach a settlement outside of court, if there is a procedural error, if the case becomes moot, or if the plaintiff decides not to pursue the case further.
Types of dismissal:
- With prejudice: If a case is dismissed with prejudice, it means the case cannot be refiled later.
- Without prejudice: If dismissed without prejudice, the plaintiff may be able to refile the case at a later time.
Does not include any State or Federal Court Fees or any Third-Party Costs such as Process Server or E-Filing Fees.
