POSTNUPTIAL AGREEMENT - Postnuptial Agreement - A Postnuptial Agreement, also known as a "Post-Marital Agreement," is a legal contract between a married couple that outlines how they will divide their assets and other financial matters in the event of a separation or divorce, drafted and signed after marriage.

The primary purpose of a Postnuptial Agreement is to provide a framework for handling financial matters should the marriage end, similar to a prenuptial agreement, but executed after the wedding.

These agreements can cover a wide range of issues, including the division of property, debts, and other financial assets, as well as spousal support (alimony).

While Postnuptial Agreements are generally enforceable, courts may scrutinize them more closely than prenuptial agreements because they are entered into after the marriage, when spouses may have a diminished sense of independence and could be more vulnerable to coercion.

The agreement cannot include unfair decisions regarding spousal support, unjust determinations of property division, or any language related to child custody, support, or visitation rights.

Postnuptial agreements can help couples clarify their financial expectations and reduce potential conflict during a divorce or separation.
